Terms of Service

1. Introduction

Welcome to Yunea. These Terms of Service ('Terms') govern your access to and use of the Yunea application ('Service'), operated by Cher-fez, a sole proprietorship registered in the Netherlands (KvK: 83651195). By accessing or using Yunea, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Acceptance of Terms

By creating an account or using Yunea, you confirm that you are at least 16 years old (the minimum age for GDPR consent in the Netherlands) and that you accept these Terms. If you are under 16, you may only use Yunea with parental or guardian consent.

3. Service Description

Yunea is a wellness and lifestyle application that provides:

• Menstrual cycle tracking and estimated predictions
• Ayurveda-inspired meal suggestions based on cycle phases
• Wellness routine suggestions aligned with your cycle
• Daily check-in features for mood, energy, and symptoms
• Educational content about Ayurvedic principles

4. Wellness App — Not a Medical Device

Yunea is a general wellness and lifestyle application. It is NOT a medical device as defined under EU Medical Device Regulation (MDR 2017/745) or any other jurisdiction. Yunea is not designed, intended, or suitable for medical purposes including diagnosis, treatment, monitoring, or prevention of disease. The app is designed solely for general wellness, educational purposes, and lifestyle tracking.

5. Important Health Disclaimer

YUNEA DOES NOT PROVIDE MEDICAL ADVICE. All information, content, meal suggestions, and Ayurvedic recommendations provided through Yunea are for general informational and educational purposes only. This content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ OR SEEN IN YUNEA. Always consult with a qualified healthcare professional before making any decisions regarding your health, diet, or wellness practices.

6. Fertility & Contraception Disclaimer

YUNEA IS NOT A CONTRACEPTIVE METHOD AND MUST NOT BE USED FOR CONTRACEPTION OR FAMILY PLANNING. Cycle predictions and fertile window estimates are statistical approximations only and are NOT reliable for avoiding or achieving pregnancy. We give no guarantee that any predictions will be accurate for your individual cycle. Yunea accepts no liability for unintended pregnancies or failure to conceive. If you are trying to avoid or achieve pregnancy, consult a healthcare professional about appropriate methods.

7. Prediction Accuracy

All cycle predictions, phase estimates, and fertile window calculations in Yunea are statistical approximations based on historical data you provide. Individual cycles vary significantly and can be affected by stress, illness, travel, medication, and many other factors. We cannot and do not guarantee the accuracy of any predictions. Predictions should be treated as general estimates only, not as medical or scientific certainty.

8. Ayurvedic Content Disclaimer

The Ayurvedic principles, dosha assessments, meal recommendations, and wellness routines in Yunea are based on traditional Ayurvedic concepts and are provided for educational and informational purposes only. This content represents traditional wellness practices and is not scientifically validated medical treatment. Ayurvedic recommendations are general in nature and may not be suitable for everyone, particularly if you are pregnant, breastfeeding, have medical conditions, or take medications. Always consult a healthcare professional before following any dietary or wellness recommendations.

9. User Accounts

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

10. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to access other users' data
• Interfere with or disrupt the Service
• Reverse engineer or attempt to extract source code
• Use the Service as a substitute for professional medical care

11. Intellectual Property

All content, features, and functionality of Yunea, including but not limited to recipes, routines, text, graphics, and software, are owned by Yunea and protected by Dutch and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written consent.

12. Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. We process your data in accordance with the General Data Protection Regulation (GDPR) and Dutch data protection laws.

13. Third-Party Services

Yunea uses Supabase for data storage and authentication. By using Yunea, you acknowledge that your data may be processed by these third-party services in accordance with their respective terms and privacy policies. When Yunea becomes available on the Apple App Store or Google Play Store, additional terms from those platforms may apply.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY DUTCH AND APPLICABLE LAW: Yunea, its operators, developers, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) your use or inability to use the Service; (b) any health decisions, dietary changes, or wellness practices based on information in the app; (c) any pregnancy, failure to conceive, or reproductive health outcomes; (d) inaccuracies in cycle predictions or phase calculations; (e) any actions taken based on Ayurvedic content or recommendations. Our total liability shall not exceed the amount paid by you (if any) for the Service in the twelve months preceding the claim. This limitation applies even if we have been advised of the possibility of such damages.

You expressly acknowledge that: (a) Yunea is not a substitute for professional medical advice; (b) you are solely responsible for your health decisions; (c) cycle predictions are estimates only and should not be relied upon for medical or contraceptive purposes.

15. Indemnification

You agree to indemnify and hold harmless Yunea and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your reliance on information provided through the app for health-related decisions.

16. Termination

You may stop using Yunea at any time. We reserve the right to suspend or terminate your access if you violate these Terms. Upon termination, you may request deletion of your personal data in accordance with our Privacy Policy and your GDPR rights.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the app. Continued use of Yunea after changes constitutes acceptance of the new Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of Yunea shall be subject to the exclusive jurisdiction of the courts of the Netherlands. For EU consumers, this does not affect your statutory rights under EU consumer protection laws. For users outside the EU, you agree that Dutch law governs these Terms regardless of your location.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Service Modifications

Yunea reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may add or remove features, update content, or change the user interface. We do not guarantee uninterrupted availability of the Service and shall not be liable for any service interruptions, modifications, or discontinuation.

21. User Content & Feedback

You retain full ownership of any content you input into Yunea (notes, check-in entries, etc.). By using the Service, you grant Yunea a non-exclusive, worldwide, royalty-free license to use this content solely for: (a) operating and providing the Service to you; (b) improving the Service through anonymized, aggregated analysis. This license terminates when you delete your content or account. Any feedback, suggestions, or ideas you voluntarily provide may be used by Yunea without compensation or attribution. Your personal data is governed separately by our Privacy Policy.

22. Paid Plans & Subscriptions

Yunea offers premium features through paid subscription plans (monthly or yearly). Premium includes: cycle predictions, ovulation tracking, advanced analytics, health app integrations, unlimited meal and routine recommendations, and data export. We offer a 90-day free trial of Premium features at account signup, which you may opt out of during onboarding. The trial does not require payment information and does not automatically convert to a paid subscription; you must actively choose to subscribe after your trial ends. You may also start the trial manually from your profile if you initially opted out. Paid subscriptions automatically renew unless cancelled before the next billing date. For subscriptions through the Apple App Store or Google Play Store, the platform may require cancellation at least 24 hours before renewal. You may cancel at any time through your account settings or the platform where you subscribed. Upon cancellation, premium access continues until the end of your current billing period; no partial refunds are provided, except where required by applicable law. Payments processed through app stores are subject to their respective terms and refund policies. We may change pricing with at least 30 days notice; price changes do not affect your current billing period.

23. Language

These Terms are available in multiple languages for your convenience. In case of any discrepancy or conflict between language versions, the English version shall prevail and govern your use of the Service.
